Lawyers don’t provide enough evidence to convince panel that domain was registered in bad faith.
Tumblr, the company that Yahoo is acquiring for $1.1 billion, has lost a cybersquatting claim for the domain name tublr.com.
In its complaint filed with World Intellectual Property Organization, Tumblr argued the domain name was registered as a typo of Tumblr.com to take advantage of the blogging site.
The company is probably right. Type Tublr.com into your web browser and you’ll be forwarded to one of those scammy “survey” sites that tells you that you’re today’s 100,000th visitors and you can claim a reward.
The font on the survey site is oddly similar to Tumblr’s logo font:
Tublr.com was registered about a month after Tumblr launched. Tumblr was an overnight sensation, gaining 75,000 users within two weeks of launching.
But Tumblr’s lawyers failed to provide evidence to convince the panel that the domain registrant would have known of Tumblr when he registered the domain. It appears they also bungled some evidence of search results from Google.
Tumblr has filed 16 UDRPs this year. This is the first case it has lost.
